Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

CONTEST ENTRY PERIOD: The Royal Docks Brewing Company, LLC Backyard Crusher Find a Seat Contest (the “Contest”) begins at 12:00:01 Eastern Time (“ET”) on April 2, 2022, and ends the last lawn chair is found (the “Contest Period”), with winners selected on or about June 15, 2022. Sponsor’s computer is the official timekeeping device for this Contest.

ELIGIBILITY: The Contest is open only to legal residents of the state of Ohio who are 21 years of age or older at the time of entry. Limit of one entry per person and one winner per household. Void outside these geographic areas and wherever else prohibited by law. Employees of Royal Docks Brewing Company, LLC (the “Sponsor”) and their respective subsidiaries, affiliates, advertising and Contest agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. The Contest is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right to verify eligibility of winners.

AGREEMENT TO OFFICIAL RULES: By participating in the Contest, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest.

HOW TO ENTER: Royal Docks Brewing Co. will be “losing” ten (10) lawn chairs throughout Stark, Summit and Cuyahoga counties to be located by potential winners. Searchers who find and register a chair on the Backyard Crusher website (https://www.backyardcrusher.com/lostchair) will win a prize package. Clues regarding chair locations will be revealed via emails to Royal Docks email subscribers, followed by release on the brewery’s social media channels (Twitter, Instagram, Facebook). All entries have an equal chance of winning. All entries become the property of Sponsor and will not be acknowledged or returned. Entrants are subject to all notices posted online at https://www.backyardcrusher.com/, including but not limited to the Sponsor’s https://www.backyardcrusher.com/rules. Incomplete entries will not be accepted and are void. Any attempt by any participant to obtain more than one entry will, in Sponsor’s sole discretion, be disqualified. Any attempt by any participant to obtain more than one entry by using multiple/different addresses, email addresses, identities, registrations, or any other methods will void that participant's entries and that participant will, in Sponsor’s sole discretion, be disqualified.

PRIZES/APPROXIMATE RETAIL VALUE (“ARV”): There are ten (10) grand prizes (described below), available to be won during the Contest Period with a limit of one prize per person during the Contest Period. Odds of winning are dependent on the number of participants and entries received. Blossom Music Center and Old Carolina BBQ Co. are in no way affiliated with the Contest.

TOTAL ARV: $525

The ARV of prizes are based on average prices at the time of writing these Official Rules. The ARV of prizes are subject to price fluctuations based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded. The difference of any such fluctuation will not be awarded to the winner.

No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.

WINNER SELECTION & NOTIFICATION/ODDS: Each winner must locate one of the ten (10) hidden lawn chairs during the contest. The end of the contest period will be when the last lawn chair is found and will be announced on Sponsor’s Instagram, Facebook and Twitter accounts. Prize winners will be notified following registration of the found chair. Odds of winning depends upon the number of eligible entries received. Entries submitted during the Sweepstake Period are only eligible for this Contest and do not remain eligible for any subsequent contest. Potential winners will be notified by email and will be required to sign and return a Declaration of Compliance and Release (“Declaration and Release”) and, upon request, produce identification satisfactory to the Sponsor prior to receiving the prize. The Declaration and Release must be returned within seven (7) days as indicated on the Declaration and Release. Failure to return the Declaration and Release within the specified number of days may, in Sponsor’s sole discretion, result in prize forfeiture and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. By entering this Contest, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters.

PRIZE CONDITIONS: Prizes are not redeemable for cash. Prizes are not assignable, transferable and may not be substituted, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value at its discretion. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. It is the responsibility of the winning participant to arrange and/or pay for pickup or delivery of their prize. Sponsor will not replace any lost or stolen prizes. Only the number of prizes stated in these Official Rules is available to be won in the Contest. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, winners will be determined in a random drawing from among all eligible claimants making purportedly valid claims in order to award the advertised number of prizes available.

Winners are responsible for any federal, state, local and income taxes associated with winning prize.

Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, biographical information, statements and likeness, throughout the world in all media now known or hereafter existing (including print, packaging, television, radio, film, digital, internet, social media, websites, and mobile apps) in perpetuity for advertising, marketing, publicity, and promotion of Sponsor, the Contest, other Sponsor promotions, and the products or services associated with Sponsor and/or the Contest and for all of Sponsor’s internal business purposes without further compensation or right of approval.

GENERAL: Participating entrants agree to these Official Rules and the decisions of the Sponsor, and release and hold harmless the Sponsor and their affiliated companies, and all other businesses involved in this Contest, as well as the employees, officers, directors and agents of each (the “Released Parties”), from all claim, liability loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) whatsoever arising out of or in connection with their participation in the Contest, and the acceptance and use, or misuse of any prize. Participating entrants assume all liability for and Released Parties shall be held harmless against any liability for any injury, losses or damages of any kind to persons, including personal injury or death, or injury to property caused or claimed to be caused in whole or in part, directly or indirectly, by participation in this Contest, acceptance, possession, or use/misuse of the prize, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.

Entry materials/data that have been tampered with or altered are void. The Released Parties are not responsible for: (i) lost, late, incomplete, misdirected, damaged or illegible entries; or (ii) an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; ; or (iii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iv) any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from participating in the Contest.

By participating in the Contest, entrants (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the Administrator, which are final and binding in all matters relating to the Contest. Failure to comply with these official rules may result in disqualification from the Contest.

Sponsor reserves the right, in its sole discretion, to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor. If, for any reason, the Contest cannot be run as planned, Sponsor may disqualify any suspect entries or individuals from the Contest and any promotion it sponsors and (a) suspend the Contest and modify the Contest to address the impairment, then resume the Contest in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

The released parties are not responsible if this Contest cannot be administered or conducted or any prize cannot be awarded due to cancellations, delays, or interruptions resulting or arising from acts of god, war, or terrorism, civil unrest, strikes, supply shortages, natural disasters, weather, epidemics, compliance with any law or order of a governmental authority, or any other similar act, event, or occurrence beyond the reasonable control of the sponsor. By participating in this Contest, participant agrees that the released parties will not be responsible or liable for any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages to persons, including death, or to property arising out of access to and use of any website associated with this Contest or the downloading from and/or printing material downloaded from such site, as applicable. Further, sponsor shall not be responsible for any cancellations, delays, diversions, changes in service or accommodations or substitutions, or for any acts or omissions by any third parties beyond its reasonable control, including third party providers supplying any services or components of the prize(s) to winners and/or their guests, or for any resulting injuries, including money damages, costs and expenses, property damages, personal injuries or death resulting therefrom.

LEGAL WARNING: Any attempt by an individual, whether or not an entrant, to damage, destroy, tamper or vandalize this web site or interfere with the operation of the Contest, is a violation of criminal and civil laws and sponsor reserves the right to seek damages and diligently pursue all remedies against any such individual to the fullest extent permitted by law.

GOVERNING LAW AND LIMITATION OF LIABILITY: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Contest will be governed by and construed in accordance with the internal laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Contest and these Official Rules shall be brought exclusively in the Stark County Court of Common Pleas or the United States District Court for the Northern District of Ohio.

PRIVACY: As a condition of entering the Contest, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Contest and to comply with applicable laws, regulations and rules, including, without limitation, the storing of the entrant’s personal information for purposes of complying with state record retention requirements. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Contest or on Contest winner’s list.
